The publishers would want that. But I'm sure they don't want to kill all those jobs. If they agree to pay a small percentage back to the developer, like they should, then publishers would be happy and gamestop stays in business.

2 reasons I would guess. To increase comfort with the device. If something is always around, you generally accept it more.
Second I would assume this is more for the devs. When they build a game, they want you to experience it the way they intended. They don't want to wonder "If wee add the Kinect features, will some people not have the ability to use them?" By making it mandatory it eliminates that concern.

kinect can be used to turn on hte console by voice, hence it will need to be around.
it was stated somewhere that when the machine is turned off, kinect will monitor one and ONLY that one command. "xbox on"
obviously voicecontrols just suck since the speech recognition has been an utter failure ever since it was invented.
enjoy trying to make anything work unless you're a native english speaker :P
