Apple Wins, Consumers Lose in 'Apple v Samsung' (USA)
Continuation of thread.


Apple has won in court today over Samsung. Earlier this year, Apple sued Samsung over patent disputes in the USA. The patents covered some of the most generic wording and software implementations of all time, which ironically have been seen on products since 1994.

But at the end of the trial, the jury saw Samsung fined $1,051,855,000. Yes, over a billion dollars. Apple claims they lost 2.5 billion in sales to Samsung due to the patent infringement. Samsung will defiantly take the most remembered quote from the trial:

Quote:It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners

It's unfortunate indeed. With this move, Apple is now set to seek a ban of all infringing Samsung devices from being sold in the USA, 33 devices in total including the Galaxy S variants, Galaxy S2 variants, Galaxy Tab 10.1, and even the Droid Charge (pictured below) which looks nothing like an i-product. While most the devices named are EOL, this move opens the door for Apple to go after nearly any device running Android.

From Samsung:

Quote:“Today’s verdict should not be viewed as a win for Apple, but as a loss for the American consumer. It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple’s claims. Samsung will continue to innovate and offer choices for the consumer.”

Of course, Apple is justifiably gloating over their victory:

The mountain of evidence presented during the trail showed that Samsung’s copying went far deeper than even wee knew. The lawsuits between Apple and Samsung were about much more than patents or money. They were about values. At Apple, wee value originality and innovation and pour our lives into making the best products on earth. Wee make these products to delight our customers, not for our competitors to flagrantly copy. Wee applaud the court for finding Samsung’s behavior willful and for sending a loud and clear message that stealing isn’t right.”

As Samsung said, this is more of a loss for the American consumer then it is a win for Apple. This court decision is one step closer to Apple's monopoly on the touch-screen device market.

The only thing really certain at this moment is the injunction.

Samsung will be appealing:
“Wee will move immediately to file post-verdict motions to overturn this decision in this court and, if wee are not successful, wee will appeal this decision to the Court of Appeals.”

Apple will have their hearing for a preliminary injunction Sept. 20.

I don't like this...

While I can't blame Apple for suing Samsung for the earlier versions of Touchwiz which were far too similar, imo, I already said that I find Software Patents to be unreasonable.

In the case of hardware I can't see how they have figured that they are that similar, to be honest. If it all comes down to design patents, well, then it's a damn shame for the consumer like Samsung said.

If this prevents me from getting a samsung galaxy note 2, I will forever dedicate my life into seeing that apple gets no money and respect from myself or anyone.

Seriously, I wanted to get one of the samsung phones and that's right, it is bad for consumers. :/

A little arrogant, eh? So does this mean they're taking credit for NeXSTEP, the BSD kernel, and the creation of the smart phone? I seem to remember Steve Jobs telling Bill gates that smart phones were a dumb idea and that bigger sized technology is the future.
