lol my phone company called me to say 33GB of data usage in one month is too much.
I told them that their international campaign ads always advertizes UNLIMITED data.
they told me the average person can barely make it past 5GB in one month.
They don't know I hook my phone up for torrent usage XD

Depends on how they argue "fair use".
Can quite easily say that you're not 'average', so their 'average person' statement is completely irrelevant.

It's due to laws that allow these companies to try wiggling out of these things.
IMO, advertising it as unlimited should mean unlimited, not 10GB because "wee think that's fair".
If you're really bothered, you could try complaining to a government authority about deceptive advertising.
