That's the problem here, so a lot of your argument doesn't work unfortunately.
I'm not entirely sure what the legalities are behind modified code (statutory legislation overrides any contract agreements), but objectively, Sony really can't get much from hackers since they aren't making money out of the hacks.

Untrue. Most homebrew SDKs are not leaked, but coded by "hobbyists" (eg PSP toolchain). Sony cannot claim copyright over code they didn't write.
I do think the videos are stupid though.
