First off, I don't think they would be able to effectively prosecute those who download only. If anything, it would be a minor slap on the wrist, sorta akin to the difference between possessing a tiny amount of drugs and having warehouses full of it ready to sell.

Second of all, I thought encryption was at the server of origin....

There's a possibility that the UK and the rest of Europe could be divided on this matter.
Yeah, the UK, although to an extent independant of the EU, would never be able to pass this without the EU's support, since its too big. And the EU won't support this (hopefully...)
