Apple has openly endorsed Jailbreaking though. They've come out and said they're okay with it. It's not like Sony falsely saying that you're breaking the law.

I saw it on Gizmodo earlier this year. I can't find the link atm, but I also read an article about it in this month's Macworld. It talks about how Apple was fine, because they didn't lose any money from it, and it brought iPhones to regions where they weren't released, meaning that demand for them grew elsewhere. It was the jailbreaking and unlocking that made it such a crazy hit all over the world, not just in the US.

If I recall correctly, I don't think it can even access the jailbreak apps, just the App store ones.

This is all moot, as anyone who likes their privacy probably already jailbroke their iPhone, and there's a simple program that disables the killswitch.
