I have a feeling that they're using the leaked 3.40 OE source code to build their CFW.
In the response video they said they couldn't get games 3.51+ to work, also in one of the videos the VSH menu says it is set to "3.xx kernel".

My powers of deduction are kinda stale but I think I'm right on this one.
