proving a DDOS attack is very difficult as in most countries you have to prove it was effective, so short of the site being taken offline by an attack there isn't much you can do about it. And to my knowledge TPB has only been offline recently when the Swedish government 'borrowed' there servers, thieving pirates that they are. :D

Yeah probably.  Their main thing is the email, so it really boils down to whether they can make it sound significant...
