That link doesn't say anything about it actually being there, just a suspicion. Where are the sources saying it's there?
So besides the sound and wallpapers what benefits are there to this theme in Win8 that I can't easily replicate in Win7?

Anyway, wee've gotten entirely off topic here. I apologize.

Doesn't say anything to do with Windows 8

Sounds like something for ISPs or law enforcement, not on your OS.
It's being distributed to social media networks, local law enforcement agencies, and ISPs. However, the service still has to be running locally so it can call home. I doubt these places are going to be tapping into suspected PCs. And if it's not blatantly stated that it's limited to Windows 8 only, then that probably means it's going to be used on all Windows systems.

My understanding was that the ISP monitors the connection and scans for images there.  I don't understand why it actually needs to be installed on consumer PCs at all...

It's not like this can't be tested anyway - with most connections behind NATs, there'd have to be some application dialing out every now and then.  If it were the case, surely it would've been noticed by now.
If it's a future Windows Update or similar, then that's another thing and not really a Windows 8 concern.
