What about the iPod/iPhone/iPad and how much they've been jailbroken? Last time I checked, people are overcomming all the Apple hurdles to make apps for them.
Don't get brainwashed by studios that piracy destroys a market. It has been shown by a number of studies that it doesn't, and in many cases has a reverse effect.
A game/console fails because it's poo poo in some way (even if it's marketing), not because of piracy.
Anyway, one's individual decision has very little impact on the success of a console. Unless you're in a position of power or have great influence, it's best to accept that following your own morals probably get you nowhere (but personal satisfaction perhaps).
I agree with you Zinga, every console I can think of, the first I can think of is the SNES, got pirated and piracy always had little impact if the console itself was decent, which to be honest, the PSP was really not >.<

piracy in DS is also rampant, but it do not affect sales of the DS line

It wasn't that bad. It's best games definitely did not come till later though.

It wasn't that bad. It's best games definitely did not come till later though.
I believe the release price of the DS was cheaper than the PSP. Add the fact that the device was somewhat more novel (one of the few touchscreen devices back in 2004) and games were out that really took advantage of it.
I personally thought the novelty of the DS (and Wii) would wear off, but there are many people out there who think otherwise (including many of my friends who thought the DS to be the better choice). It was in fact the hacks available on the PSP which made it a little more interesting (eg universal remote, emulators etc).
Did the DS have backwards compatibility with GBA games? If so, that could also be partially a reason.
