though technically this doesn't happen, but it could.,

Apple has openly endorsed Jailbreaking though. They've come out and said they're okay with it. It's not like Sony falsely saying that you're breaking the law.

Where exactly have they said that, just out of interest? I havent seen that

I saw it on Gizmodo earlier this year. I can't find the link atm, but I also read an article about it in this month's Macworld. It talks about how Apple was fine, because they didn't lose any money from it, and it brought iPhones to regions where they weren't released, meaning that demand for them grew elsewhere. It was the jailbreaking and unlocking that made it such a crazy hit all over the world, not just in the US.
yea.. It was the Illegal Unlocking that made iPhone a hit in countries where Apple never considered selling the iPhone. Now this is one sad donkey deal for anyone who wants to run the grey stuff .. or the stuff that Apple doesn't recognize. Fine, with the hacks and mods, you can stop Apple from contacting ur iPhone, but I wonder to what effect.

If I recall correctly, I don't think it can even access the jailbreak apps, just the App store ones.

This is all moot, as anyone who likes their privacy probably already jailbroke their iPhone, and there's a simple program that disables the killswitch.
That is fine.. but the point I'm making is that Apple should have publicised it before launch and then at least given a choice to switch it on and off. Like recovery in our pc, if you like. Not force people to live with it or turn geeky and find a way to kill it.
